The permittee has applied for a modification to their existing State Pollutant Discharge Elimination System (SPDES) permit (NY-0068276). The proposed modification involves the replacement of an existing wastewater treatment system which discharges to groundwater with a sand filter system that will discharge to surface water. Under the existing permit, the permittee is authorized to discharge up to 18,750 gallons per day to groundwater. The proposed modification would authorize a surface discharge to Claverack Creek of up to 27,307 gallons per day. Upon completion of construction of the sand filter system, the discharge to groundwater shall cease.
The Department has made a tentative determination to issue a SPDES modification under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought, or for the overall project. A copy of the draft permit is available for review upon request.
The installation of the outfall structure and associated piping will result in a temporary impact to Freshwater Wetland HS-4 and its 100-foot adjacent area. In addition, the outfall structure itself will result in a minor impact to Claverack Creek.
The project is located on the north side of New York State Route 66 in the Town of Claverack, Columbia County.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.
State Environmental Quality Review (SEQR) Determination:
Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination:
A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
