The applicant proposes the treatment of up to 10 acres of the near shore of Round Lake, excluding Freshwater Wetland MO-12 and its 100-foot adjacent area, with the aquatic herbicide Navigate (2,4-Dichlorophenoxyacetic acid) for the control of aquatic plant species: water lilies, spatterdock, and eurasian milfoil The applicant proposes the treatment of the entire lake outside wetland MO-12 and its adjacent area with copper sulfate for the control of planktonic algae.

Project Description:

Applicant is proposing to construct an 850,000 square foot shopping center and associated parking features on a 127.6 acre parcel in the Town of Newburgh, Orange County. The proposed site is located immediately north of Interstate Route 84 and immediately east of Interstate Route 300. The proposed development will require a Water Quality Certification (WQC) for the filling of 1.05 acre of federal wetlands. Approximately 2 acres of onsite wetland mitigation, in the form of enhancement to existing wetlands, has been proposed and being reviewed by the Army Corps of Engineers (ACOE). A stormwater Pollution Prevention Plan (SWPPP) is currently being reviewed by the DEC.

Article 19 Air Title V Facility

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue the permit for the applicant's facility pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments.

The Bedford Hills/Taconic Correctional Facility is located in Westchester County, NY. The facility plans to install two new 1500 kw Caterpillar generators at Bedford Hills to be used in an energy demand response program and for emergency use. The generators will burn diesel fuel. The facility has requested and the Department tentatively approved a variance from the 6NYCRR Part 227-2.4(f)2(ii)(b) NOx RACT limits for the two new generators. These new generators will meet 40 CFR 60 NSPS Subpart IIII standards and are expected to operate less than 500 hr/yr. A variance from Part 227-2 is not being requested for the existing 1000 kw generator. The 1000 Kw generator will remain an exempt source as defined by Part 201-3.2(c)(6).

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.
