Project Description:

The Department has made a tentative determination to modify a permit for the Ellicott Subheadquarters. The permit (NY-0171671) would be modified to approve the surface discharge of a maximum 875 gallons per day of treated sanitary waste water from a new system which would replace a failing system that discharges to groundwater. The existing permit also allows a discharge of up to 300 gallons per day from an oil/water separator. The receiving water is a tributary of Cassadaga Creek with a class and standard of C. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought. When commenting, please refer to this application by both the application number and the SPDES number listed in this notice.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modification to the Title V Air Facility Permit for sponge making operations at the facility. 3M Tonawanda has requested a variance from the requirements of 6NYCRR Part 212.10 (General Process Emission Sources), Reasonable Available Control Technology (RACT), for Volatile Organic Compound (VOC) emissions from the Mother Liquor wash table Emission Source 120. 6NYCRR Part 212.10 requires that sources emitting greater than 3 pounds per hour evaluate RACT controls. Source 120 emissions of VOC are proposed to increase from 2.8 pounds per hour to a maximum of 5 pounds per hour due to improvements in the process. A RACT analysis submitted with the application justifies no control at this time. All other affected emission sources currently vent to control equipment and will result in insignificant additional emissions.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. The applicant proposes to mine sand and gravel and material processing with a portable dry-screen with a maximum capacity of less than 150 tons per hour, on 11.2 acres of land out of 132.6 acres owned at the site. Proposed access/haul road will be from an existing farm access point from NYS route 77, which is located approximately 1000 feet south of the Welch Road intersection, and extending west to near the center of the eastern mine limit. The estimated life of mine is 10 years with the land being reclaimed for agricultural use.
