Public Notice

Notice is hereby given pursuant to Article 24 (Freshwater Wetlands Act) of the New York State Environmental Conservation Law and the Freshwater Wetlands Mapping and Classification Regulations (6 NYCRR Part 664) that New York State Department of Environmental Conservation (NYS DEC) proposes to amend Erie County Freshwater Wetland Map 3 of 31 originally filed in 1986. The wetland amendment would consist of adding Wetland TE-38 as a Class 2 wetland to the maps. Maps showing the proposed revisions are available at the clerks' offices in the Town of Amherst and Erie County, as well as at the NYS DEC Region 9 Office, Buffalo, NY. The wetland boundaries may be transferred onto the most recent version of New York State Department of Transporatation (NYS DOT) 7 ½ foot quadrangle map to show their proximity to mapped features. Written comments on the accuracy of the proposed changes to the maps may be mailed to the person listed below. All comments received through April 15, 2008 will be considered. Pursuant to 6 NYCRR Part 664, once the announcement of a proposed amendment has been made, no activity subject to regulation under the Freshwater Wetlands Act may be initiated without a permit from NYS DEC within the area that is the subject of the proposal (including the 100 foot wetland adjacent area) until the Commissioner has either amended the map or denied the amendment.

Positive Declaration and Public Scoping

Erie County - The Town of Orchard Park Town Board, as lead agency, has determined that the proposed Wal-Mart Supercenter may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until April 4, 2008. A public scoping session will be held on March 26, 2008 at 6:30 p.m. at the Orchard Park Town Hall, 4295 South Buffalo Road, Orchard Park, NY 14127 (Basement Meeting Room). The action involves the proposal to construct a 134,088 square foot shoppping center consisting of a retail store, pharmacy and partially enclosed garden center on an approximately 19.91 acre parcel. The project is located on Milestrip Road across from Amelia Drive in the Town of Orchard Park, New York.

Notice of Acceptance of Draft EIS and Public Hearing

Chautaugua County - The Town Board of the Town of Arkwright, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed New Grange Wind Farm. A public hearing on the Draft EIS will be held on April 30, 2008 at 7:00 p.m. at the Town of Arkwright Highway Department, 9531 Center Road, Fredonia, NY. Written comments on the Draft EIS will be accepted until 5:00 p.m. May 12, 2008 by the contact person listed below. Copies of the Draft EIS are available and may be obtained at the following locations:

The action involves the construction, operation and maintenance of multiple wind turbines in the Town of Arkwright, along with associated access roads, electrical collection system and electrical substation in the Town of Arkwright and the Town of Pomfret. Each turbine will be approximately 400 feet tall when the blade is at highest point. The project is located in portions of the Towns of Arkwright and Pomfret, New York.

Notice of Acceptance of Final EIS

Erie County - The Clarence Town Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Clarence Hollow Pollution Abatement Project / Spaulding Greens Open Space Design Subdivision. The action involves the project related development which was previously identified in the original Clarence Hollow Pollution Abatement DEIS/FEIS submitted in April, 2001. The applicant, Spaulding Green, LLC is proposing to construct approximately 380 units of housing on 419 acres of land. Specifically 64 ± units of townhomes, 62 ± units of patio homes and 254 ± units of standard single family home sites are proposed as the full build out of the project. The project sponsor is proposing to utilize the Town of Clarence Open Space Design Overlay District to protect 50% of the lands (approximately 209 ± acres) in perpetuity in exchange for reduced lot sizes for residential housing. The project is located between Clarence Center Road on the north, Kraus Road on the east, Greiner Road on the south and Goodrich Road on the west within the boundaries of the Town of Clarence, New York.
