Project Description:

The applicant proposes the removal of approximately 200 cubic yards of gravel from South McMillan Creek in an effort to reduce flooding. The project is located within the NYSDEC Conesus Inlet Wildlife Management Area and regulated Freshwater Wetland CO-1. The gravel will be removed from the site and placed in an upland area.

State Environmental Quality Review (SEQR) Determination:

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The applicant proposes to expand an existing 423.6 acre limestone quarry an additional 91.3 acres. The Seneca Stone Quarry is located north of County Road 121, west of Hoster Road and east of Rt 414 and Reed Lane in the Town of Fayette, Seneca County. The mine operates as a traditional surface extraction of limestone by drill and blast methodology. Mining will not occur below the local water table. No other changes are proposed for the mining operation. The primary objective of the proposed expansion is to develop new aggregate reserves to replace those currently being depleted. The reviewed LOM for this modification is 91.3 acres.

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
