Project Description:

The Department is proposing to renew and modify the SPDES permit, as well as issue a Part 401 Water Quality Certificate (WQC) for the Entergy Nuclear Fitzpatrick Station, LLC (Fitzpatrick). The WQC is being issued as part of the federal nuclear license renewal process. Fitzpatrick is an 866 MW nuclear powered electric generating facility located on the eastern basin of Lake Ontario. The facility withdraws a maximum of 596 MGD as part of a once-through cooling system. The SPDES permit authorizes the discharge of non-contact cooling water, stormwater, service water and boiler blowdown. The permit is being modified by the Department to require the construction and installation of a fish return system to reduce impingement of fish and to require additional sampling for fish larvae and fish eggs at near and far shore adjacent to the facility. The facility will be required to determine the reduction in impingement and entrainment as well as the cost of relocating the intake structure to greater depth in the far shore areas. The facility will also be required to examine other technologies and operational measures to minimize impacts, such as variable speed pumps and helper cooling towers. Based on these analyses the Department, by the end of the 5 year permit term, will determine if the facility will be required to take additional measures to reduce facility impacts to Lake Ontario. The authority to require the installation of technologies and the submission of additional information related to the minimization of adverse impacts is pursuant to 6 NYCRR Part 704.5 and 40 CFR 125 - Subpart J. The Part 401 Water Quality Certificate being contemplated for issuance is associated with the federal license renewal proceeding by the Nuclear Regulatory Commission (NRC). The NRC is contemplating issuing a license renewal to the facility for additional 20 years. In accordance with the CWA the NRC may not issue the license renewal until the Department has issued the WQC. The Department has determined that in order for the facility to meet state water quality standards set forth in Part 704.5 it must comply with the biological conditions outlined above for the SPDES permit. As such, the Department is including these requirements in the WQC as well. Copies of the draft SPDES permit and WQC are available for review upon request.
