Project Description:

The applicant has applied for a permit to impact ~0.448 acres of regulated NYS DEC Freshwater Wetland (FWW) R-32 [Class 2] and ~0.935 acres of its Adjacent Area (AA) for the proposed development of a 38-lot residential subdivision on a ~80.47-acre parcel. Impacts to the FWW and AA will occur from a town-required secondary access road for emergency vehicles. The creation of ~1.1 acres of wetland in two locations has been proposed as compensatory mitigation. The site is located on the west side of Macelroy Road, ~4200 feet north of the intersection with SR 146A.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Clifton Park Town Board

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Mar 13, 2008.
