Project Description:

The applicant proposes to construct a 273-unit condominium complex on a 113 acre site located on the north side of Nichols Street, approximately 0.3 mile west of the intersection with NYS Route 52. The Department has made a tentative determination to approve the modification of the SPDES permit previously issued for this project, which now involves the discharge of a monthly average of 70,000 gallons per day (GPD) of treated wastewater to an unnamed tributary to Palmer Lake (AKA Michael's Brook), a class B stream. The prior SPDES permit issued by the Department for this development, which proposed 313 condominium units, was for a discharge of up to 102,000 GPD to the same stream. In addition, effluent limitations for phosphorous will be reduced from 1.0 mg/l in the prior permit to 0.05 mg/l; and seasonal effluent limitations for nitrogen will also now be imposed. In addition, the Department's decision on the draft SPDES permit is contingent on the applicant's formation of a sewage works corporation in accordance with Article 10 of the New York State Transportation Corporations Law, or satisfying the criteria for a variance pursuant to the Department's SPDES regulations contained in 6 NYCRR Part 752.1 (f). A draft SPDES permit has been prepared (SPDES No. NY-0207322) and is available for review at the DEC Region 3 Office during normal business hours and by appointment.
In addition, the applicant has applied for a public water supply permit to replace the public water supply permit previously issued by the Department for this project. The current permit application requests the taking of an average of 70,000 GPD from four on-site water supply wells. Based on well pump tests conducted in 2007, the four wells have a combined tested capacity of up to 99 gallons per minute (GPM), which is over twice the capacity needed to meet the average daily demand of 48.7 GPM. The prior permit authorized the taking of an average of 61,625 GPD from the same wells.
Development of the site will also involve construction within State-designated Freshwater Wetland LC-57 (Class I) for installation of stormwater management measures, water supply wells and distribution lines, completion of the wastewater treatment plant, portions of 10 residential units, and portions of the roadway system. A total of 0.49 acres of Wetland LC-57 and 5.6 acres of the wetland 100-foot adjacent area will be impacted by construction. In addition, approximately 0.73 acres of federally-regulated wetlands will be impacted by construction. To mitigate wetland impacts, existing on-site wetlands will be expanded by approximately 2.62 acres. Construction of the wastewater treatment plant outfall on the banks of the unnamed tributary to Palmer Lake (Class B) will also require an Article 15, Protection of Waters permit.

The New York State Department of Environmental Conservation has received a permittee initiated modification for Meenan Oil Company SPDES # NY 023 5059 (DEC ID # 3-3730-00141/00001) permit for the addition of outfall 002.
This draft permit has been modified from the existing SPDES permit in the following ways.

Draft Permit Limits:

A settleable solids limitation has been added to the existing outfalls 001 and 002 in compliance with the guidance limitations for a petroleum storage facility with oil/water separators.
The action level of 100 ug/l for benzene was changed to a calculated water quality based effluent limit of 5 ug/l.
The action levels for ethylbenzene, toluene, and xylene of 100ug/l were changed to a calculated water quality based effluent limit of 27 ug/l.

Meenan Oil Company has surface discharge in to Tonetta Brook, a class A water.

Additional information including the current permit, renewal application and supporting documentation may be obtained from or inspected at the DEC Central Office in Albany. Substantive coment on the permit or requested for hearing or both must be submitted in writing to the contact person, DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
