Project Description:

Excavation of approximately 1,482,103 tons of topsoil, sand and gravel from a 27.70 acre expansion of an existing 17.90 acre surface unconsolidated mine over an estimated 8 years. The proposed 27.70 acre mining expansion involves increasing an existing 17.90 acre mined lake to a surface area of 39.60 acres with six adjacent acres of shoreline and upland area. Material in the area of the lake expansion is proposed to be mined approximately 43 feet below the seasonal high water table. All material is to be hauled to an existing permitted processing area, with the exception of the topsoil and overburden which is to be utilized in reclamation along the shorelines and benches of the excavated areas. After the mining operation is completed, it is intended that the site be reclaimed as a natural wildlife sanctuary. The 27.70 acre expansion of the existing 17.90 acre surface unconsolidated mine is located approximately 1,500 feet south and west of Barberton Road, and is immediately east of the Norfolk Southern Railroad which is east of NYS Route 305.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination:

A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The NYS Department of Environmental Conservation proposes to modify State Pollutant Discharge Elimination System (SPDES) Permit No. NY-0032093 for the existing discharge of 2.203 million gallons per day of treated sanitary wastewater from the Village of Gowanda Wastewater Treatment Plant (WWTP) to Cattaraugus Creek. The draft permit modification resulted from a full technical review under the Department's Environmental Benefit Permit Strategy. This permit establishes new effluent limitations for total organic halogen, total ammonia and chlorine residual. The draft permit includes a schedule of compliance to attain the more stringent effluent limit for residual chlorine. The previous schedule of compliance for short term monitoring has been replaced with one requiring short term monitoring for Copper (total), Zinc (total), Bromomethane, CIS 1, 3-Dichloropropene, Trans 1,3-Dichloropropene and Trichloroethene. The Village of Gowanda WWTP is located on Aldrich Street in the Village of Gowanda. The draft permit, fact sheets and supporting documents are available for review and comment at the address below.
