Project Description:

The New York State Department of Environmental Conservation (NYSDEC) has received a permittee initiated modification to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 007-1111, DEC Identification #: 7-1128-00002/002-0), the Texas Eastern Products Pipeline Co. Facility. The changes to the permit are as follows:

This modification is in response to the permittee's request for department reconsideration of the assigned Chloride limit of 250 mg/l of December 2006. The modification allows for a study of the Chloride and TDS concentrations in the receiving water (intermittent stream) during regular discharges, and also an evaluative bioassessment of the affected drainage stream. The department will review the study information when received to determine whether any further consideration of limitation is warranted. An interim Permit with a compliance schedule to allow a study of chloride concentrations associated with releases of brine from the holding ponds during suitable seasonal flows. The original TDS limit of 500 mg/l, and the Chlorides limit of 250 mg/l, are to be retained. The Texas Eastern Products Pipeline Co. Facility has surface discharge into the East Branch, Owego Creek a class C(T) water.

Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
