Public Notice

The New York State Department of Environmental Conservation (NYS DEC) has determined that the Registry of Inactive Hazardous Waste Disposal Sites in New York State needs to be amended to delete site number 152037, known as the Action Anodizing Plating and Polishing. This site is located in the Town of Babylon, in the County of Suffolk, and is located at 33 Dixon Avenue. The reason for deletion is:

Remediation was carried out via an Interim Remedial Measure (IRM). This was followed by a No Further Action Record of Decision (ROD). The United States Environmental Protection Agency (EPA) deleted this site from the National Priorities List (NPL) with State concurrence in 1995 following two final rounds of groundwater sampling per the ROD. No further monitoring is required. It has been determined that this site does not pose a significant threat.

Conditioned Negative Declaration

Suffolk County - The Town of Brookhaven Town Board, as lead agency, has determined that the proposed Pitelli Development Inc. - Land Division will not have a significant adverse environmental impact provided specific conditions are met. There will be a 30 day public comment period commencing with the date of this notice. The action involves the request for a Wetlands and Waterways permit in connection with the proposal to divide a 4.75 acre parcel into four lots, three of which conform to the underlying zoning and to grant a variance from the wetlands overlay district for Parcel # 3 and Parcel # 4 as depicted on the survey submitted in connection herewith dated August 20, 1997 last revised February 27, 2007. The project is located N/S of Parsonage Road, 231 feet E/O Peters Path, in East Setauket, New York.

The conditions are: In order to reduce the potential impacts of flooding to the adjacent wetlands and surrounding residential structures, caused by the unusual surface and subsurface geology, the total number of lots upon which we will permit regulated activity shall be two, not four as proposed by the applicant, thereby denying the permit for regulated activity on proposed lots 3 & 4 as depicted on the survey submitted in connection herewith dated August 20, 1997 last revised February 27, 2007.
