Project Description:

The applicant proposes to expand an existing 85 acre surface sand and gravel mine an additional 119.7 acres to the southwest and contiguous to the currently permitted mine. The St. Johns Pit is located on NYS Route 63 in the Town of Batavia, Genesee County and operates as a traditional surface extraction of sand and gravel. Mining within the expansion acreage will be done by mechanical equipment similar to the existing mining operations and include the use of a dragline or excavator to mine above and below the local water table. Mining will occur in five phases starting in the eastern section of the expansion area and progressing to the west, north and south across the site over the life of the mining operations. It is difficult to estimate how long each phase will take to complete as a result of local economic and market forces as the need for these resources fluctuate over the operational life of the mine. No dewatering will occur in the expansion area. A portion of the expansion area along the northern life-of-mine (LOM) boundary, generally north of the Buckeye Pipeline, will not be excavated but will be used for the stockpile of materials. No other changes are proposed to operational activities, reclamation plans, production volumes, or vehicle trips, etc. at this mine other than the lateral expansion of the extent of the LOM. The reviewed LOM area for this modification is 119.7 acres.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The State University of New York (SUNY) has submitted an application to modify its Air State Facility Permit for the Brockport Campus. Emission sources at this facility include 8 natural gas fired boilers totaling 117.2 million BTU per hour heat input. The facility also operates a number of exempt sources including small combustion units and back-up generators. The data submitted by the facility indicates that potential emissions of oxides of nitrogen (NOx) may exceed the major source threshold of 100 tons per year as specified in 6 NYCRR Part 201-6 (Title V). Facility records indicate that actual emissions of NOx and other regulated air pollutants are below the major source thresholds.
In this application, SUNY Brockport has proposed to limit facility-wide fuel use at existing levels to maintain NOx emissions below the major source thresholds.
In response, the Department has generated a Draft Permit restricting potential NOx emissions by limiting fuel use during any 12 month period. Draft Permit conditions limit facility-wide emission of NOx to less than 90 tons per year on a 12-month rolling basis. Fuel usage data shall be recorded, and calculations of monthly NOx emissions and 12-month rolling totals of NOx emissions will be required to verify compliance. These records are to be maintained for a minimum of five years, and must be made available with all supporting data to Department inspectors upon request.
The application and Draft Permit are available for review at the NYSDEC Region 8 office.
