Project Description:

The applicant proposes to continue discharge of 12,000 gallons per day (GPD) of domestic sanitary wastewater after treatment by septic tank and sand filter from Outfall 003, and 600 GPD of floor drain wastewater after treatment by oil/water separator from Outfall 004, both to a Class "D" tributary of Ray Brook, and discharges of 8,000 GPD from Outfall 001 and 4,500 GPD from Outfall 002 of sanitary wastewater after treatment by septic tank and absorption system to groundwaters (Class GA), at the applicant's school facilities located on the east side of St. Rte 22, south of Spellman Road. The Department has prepared a draft permit which contains a compliance schedule requiring submission by July 1, 2008, of an engineering report and plans for the upgrade of the Outfall 003 system to include flow monitoring, phosphorous treatment and disinfection, and for the Outfall 004 system, for the installation of a new bus garage floor drain treatment system, with completion of both systems by March 1, 2009. The Department has made a tentative determination to issue a renewed and modified permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. Project Description:

Marble River, LLC proposes to construct a wind-powered electrical generation facility in the Towns of Clinton and Ellenburg, Clinton County, on a project development area totaling 18,520 acres of leased private land. Project components include 109 wind turbines each with a nameplate capacity of 2.0 megawatts (MW), 42 miles of gravel access roads, 56 miles of 34.5 kV underground electrical collection lines and 10 miles of 34.5 kV overhead electrical collection lines, an operations and maintenance (O&M) facility, a combined interconnection/substation, 3 permanent meteorological (met) towers, and temporary storage laydown yards.
Construction of the project is anticipated to result in 8.84 acres of permanent impacts to wetlands as a result of fill activity; 22.38 acres of permanent impacts to wetlands as a result of conversion of forest cover to emergent or shrub-scrub cover; 24.32 acres of permanent impacts to regulated wetland adjacent areas; and 893.95 linear feet of permanent impacts to streams. In addition, the project is expected to result in temporary impacts of 42.25 acres of wetlands, 100.95 acres of adjacent areas, and 1,903.51 linear feet of streams.
To mitigate permanent impacts to wetlands that result from project construction, the applicant proposes a combination of wetland creation, enhancement and restoration totaling 36.06 acres at six potential sites in the project development area. Impacts to streams will be mitigated by installation of appropriately designed and sized culverts at all stream crossings, including replacement of existing substandard culverts totaling 521.7 linear feet of streams along access roads upgraded as part of the project development. To further compensate for stream impacts, two degraded stream banks are proposed for restoration 125 feet along the English River, and 400 feet of an unnamed tributary to Brandy Brook; and a cattle crossing and watering areas are proposed for construction across the Hinchinbrook Brook and English River, respectively.

The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Project Description:

This Notice is for renewal of an existing State Pollutant Discharge Elimination System (SPDES) permit for an existing discharge of 35,000 gallons per day of treated wastewater to groundwater from a secondary treatment plant at the applicant's facility located at the Lyon Mountain Correctional Facility, Route 374, Lyon Mountain in the Town of Dannemora, Clinton County. The applicant plans to continue to operate the facility. In addition, the Department has made a tentative determination to modify the permit by 1) increasing the monitoring frequency for effluent nitrate from quarterly to monthly, 2) deleting the dissolved oxygen monitoring requirement, and 3) requiring submission of an annual report instead of monthly reports. As a tentative determination, the Department seeks comments prior to making a final decision on permit renewal.
