Project Description:

The applicant proposes to construct an earthen dam with a maximum height of 18' to impound surface runoff into a 12 acre pond for recreational purposes. The proposed pond will impound a maximum of 116.27 acre feet of water. The pond is also associated with the discharge of dredged or fill material into the waters of the United States as regulated by the US Army Corp of Engineers and outlined in an October 2007 restoration plan. The restoration plan includes a wetland planting plan for restored areas and the placement and stabilization of excavated material in an approved upland disposal site. The pond is being constructed in conjunction with other property improvements which previously included a motorcycle race track, new home, and other associated activities/structures. The site is located on the west side of Post Hill Road, north of Columbia County Route 10 and east of Churchtown Road.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Feb 08, 2008.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a Air State Facility Permit for the application for the Hess Rensselaer Terminal facility located on 367 American Oil Road, City of Rensselaer, County of Rensselaer, owned by Hess Corporation, 1 Hess Plaza, Woodbridge, NJ. The facility stores and transfers refined petroleum products. The company proposes to install a new internal floating roof with both primary and secondary seals into Tank 1506. The tank will be used to store refined petroleum products (gasoline & distillate) and lower vapor pressure alternative fuels, such as ethanol. This project will also include the additional process of blending lower vapor pressure products alternative fuels, such as ethanol, at the loading rack. This project does not entail the increase of product throughputs. Persons wishing to inspect the subject Air State Facility files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative below. The Draft Permit may be viewed and printed at: http://www.dec.ny.gov/chemical/32249.html. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below.
