Project Description:

The Department has made a tentative determination to approve this application for a new SPDES permit # NY- 027 2728 for The Waterlands 1 Real Estate Development to discharge up to 20,000 gallons of treated wastewater per day to an unnamed sub-tributary to Little Wappinger Creek (NYS Waters Index number is H-101-18-12-3-1; Class D). A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 headquarters in New Paltz. The permittee will be required to maintain records and report data to verify compliance with the SPDES permit conditions and discharge limits.
This new system is proposed to serve a new subdivision of 5 parcels totaling 196.4 acres into 23 residential lots and 6 open space/farm lots, located at Bulls Head Rd (Co Rte 19), Bentley Lane, and Willow Brook Road. This property includes portions of NYS regulated Freshwater Wetland RC-43, Class II, but no disturbance is proposed to the wetland or its 100-foot Adjacent Area.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Stanford Town Planning Board

State Historic Preservation Act (SHPA) Determination:

A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The applicant proposes to install approximately 9,900 linear feet of eight inch diameter sewer pipe along NYS Route 17B, a portion of which will be located within the 100-foot adjacent area of State-designated Freshwater Wetland WL-25 (Class II) and will cross two tributaries of Black Lake (DEC Class B). The project limits extend from the intersection of NYS Route 17B and NYS Route 55 west approximately two miles along NYS Route 17B to just west of Whitmore Road. In addition, one pump station and a portion of a stormwater detention basin will be located within the 100-foot adjacent area of the wetland. The project will result in the total disturbance of approximately 0.01 acre and 0.16 acre of the wetland and its 100-foot adjacent area, respectively.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
