Project Description:

Applicant is proposing to construct a section of cantilevered terrace, cause modifications to the existing boardwalk and regrade and replant an area landward of the existing boardwalk. These listed activities are regulated by the NYSDEC under Article 34, Coastal Erosion Hazard Areas Act and are associated with a larger project, i.e., the construction of a 37,291 square foot catering facility, including the construction of additional parking. The catering facility and additional parking area are beyond the jurisdiction of Article 34 (CEHAA). The proposed catering facility is on the approximate location of the former Boardwalk Restaurant in the Central Mall Area of Jones Beach State Park and the subject regulated activities are directly seaward of the Mall. The entire project is beyond the jurisdiction of Article 25 (Tidal Wetlands Act).

Project Description:

The applicant proposes to install a Substratum Intake System (SIS) and conduct a field test of this pilot system to determine the potential this technology has to provide a sufficient volume of cooling water for a power plant. The SIS will consist of two, twelve inch bores that will be installed by horizontal direction drilling (HDD) from the upland area to a distance of 500 feet out horizontally underneath the seabed of Long Island Sound. The twelve inch bores will be cased with steel liners. High density polyethylene pipes with 100 foot stainless steel well screens will be inserted in the pipes and pushed out into the substrate. The wells will be approximately 30 to 60 feet below the seabed with no point of exit in the sound. A vertical production well capable of providing sterile substrate water may also be installed to provide the volume of water necessary for the HDD.
After the wells are developed, pump tests will commence drawing in sterile saline substrate water from under the sound. The flow rates during hydraulic testing are expected to range from 1,200 gallons per minute (gpm) to 4,000 gpm.
Two condenser simulators will be constructed and housed in a trailer on site. Each simulator will utilize condenser tubes similar to those found at typical steam electric generating plants. The tubes will be wrapped with an electric strip heater to mimic heat loading from a power plant and will heat the water flow (10gpm) approximately 25 degrees F. One simulator will be connected to one of the lateral wells, the second condenser simulator will be fed raw surface water from a submersible pump in the Shoreham intake canal. No biocide injection is proposed, and both simulators will discharge into the existing Shoreham outflow diffuser pipe.
The project will be located on the east side of the intake canal of the former Shoreham Nuclear Facility which is located on North Country Road, Shoreham, in the Town of Brookhaven.

The applicant proposes a discharge of 290,000 gallons per day average of non-contact cooling water and 25 gallons per day of boiler blow down wastewater and the addition of one Sanitary Outfall to groundwater from the applicant's facility located at 500 Commack Road, Commack. The applicant plans to continue to operate a non-manufacturing pharmaceutical packaging center.
The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for, or endorsement of, the activity for which a permit is sought or for the overall proposed project.
