BROWNFIELD CLEANUP PROGRAM

The New York State Department of Environmental Conservation (NYS DEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.

NYS DEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYS DEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Genesee County - The Town of Bethany Town Board, as lead agency, has determined that the proposed 2007 Amendments to the Town of Bethany Zoning Law will not have a significant adverse environmental impact. The action involves the adoption of a comprehensive local law, regulating the development of wind power installations. The law is necessary to protect the interests of the Town and its residents and has drafted various amendments to the Town of Bethany Zoning Law to promote the effective and efficient use of the Town's Wind Energy Resource through Wind Energy Conversion Systems (WECS) without harming public health, welfare and safety of the Town's Residents. The project is located town wide in the Town of Bethany, New York.

Orleans County - The Town of Yates, as lead agency, has determined that the proposed Town of Yates Water District No. 4, Phase VIII will not have a significant adverse environmental impact. The action involves the installation of approximately 12,300 linear feet of watermain along Alps Road and East Yates Center Road to serve Water District No. 4 Phase VIII. In addition to the watermain, the project includes hydrants, valves, road crossings, excavation and bedding materials, watermain connections, residential hook-ups, and surface restoration. Residents of the area are dependent upon individual groundwater supplies that historically have produced very low yields of poor quality water. The project is located along portions of Alps Road and East Yates Center Road in the Town of Yates, New York.
