Project Description:

The applicant proposes a discharge of up to 10,000 gallons per day of treated sanitary wastewater to Fox Creek, a Class C(t) waterbody from a septic tank and sand filter at the applicant's facility located at 1425 Helderberg Trail, Town of Berne, County of Albany, State of New York. The applicant plans to operate a church camp for up to 100 campers at a time during the summer season. Long-range plans call for the renovation of the existing hotel on the grounds so that it can be used for off-season weekend retreats for up to 200 people.

The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System Permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

A draft permit is available for inspection and comment at the Region 4 Office, 1130 North Westcott Road, Schenectady, New York.

Project Description:

The applicant has applied for a modification to an existing Mined Land Reclamation Permit, and State Pollutant Discharge Elimination System (SPDES) permit for an existing 143 acre rock quarry on Route 43 in the town of West Sand Lake, which includes blasting operations. The proposed modification would reduce the existing bedrock excavation area from 85 acres to 62 acres, and lower the mine floor from 530' msl to 430' msl and mine below the water table in a 35 acre area of the existing quarry. A public comment period was held on the DEIS in May, 2006, and as a result of the comments received, the Department requested additional information relative to groundwater and well concerns. The Department feels it necessary to provide additional opportunity for the public to comment on the supplemental information. Comments will be accepted until February 1, 2008. The DEIS dated May, 2006, and resulting additional hydrogeologic information is available at the Town of Sand Lake, Town Clerk's Office, 8428 Miller Hill Rd, Averill Park, NY 12018, Sand Lake Library, Miller Hill Road, Averill Park, NY 12018, and the NYS DEC Region 4 Headquarters, 1130 North Westcott Road, Schenectady, NY 12306. Written comments may be mailed to the contact person below and must be received within 30 days of the date of this notice. Comments should include specific information relative to the project.
