The New York State Department of Environmental Conservation (NYS DEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for the site indicated above.

NYS DEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYS DEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Erie County - The Erie County Department of Environment and Planning, as lead agency, has determined that the proposed Chaffee Hamlet Sidewalks and Water System Improvements will not have a significant adverse environmental impact. The action involves the separate contracts for sidewalk construction - funded with Community Development Block Grant funds; and water improvements - funded substantially with New York State Drinking Water Revolving Loan Fund. The sidewalk work will replace deficient existing sidewalk, and new construction in portions where none currently exists - along the south side of the eastern end of Allen Street and portions of local roads. The water system improvements upgrade a deficient private water system, approximately 100 years old, determined to be under the influence of surface water. This shall include design, engineering and construction of comprehensive replacement of the well, treatment and monitoring equipment, water storage facility, and delivery system pipes, including tap-in valves, but not fire hydrants, as anticipated available water pressure does not support installation of hydrants. The project is located along a portion of Allen Road (county road) and adjacent Lake Street, Briggs Street, Grove Street and Manion Park Access Road for both sidewalk and water improvements and for water improvements only along the Chaffee hamlet's portion of NYS Route 16 in the Hamlet of Chaffee, Town of Sardinia, New York.
