Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 003 0864, DEC Identification #: 6-3013-00051/00001), the Rome Municipal Sewage Treatment Plant pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The changes to the permit are as follows: Whole Effluent Toxicity (WET) Testing - WET testing (Acute) is added to the permit because recent chronic toxicity was found to be present in the effluent during special testing for the modification application. Recommended by the Division of Water Toxicity Testing Unit. Nitrogen, Ammonia - The seasonal periods have been adjusted to delete the single period of May 1 - May 31and its specified limit, extend the "Summer" period from May 15 to November 15, and extend the "Winter" period from November 16 - May 14. A Daily Average (DA) reporting requirement is also added for all seasons. Nitrogen, TKN - New "Monitor" requirements for DA concentration and mass, and DM (Daily Maximum) for mass. Toluene - A "Monitor" requirement is added because this compound was detected in the influent during pretreatment monitoring, although all effluent values were non-detect (ND). 1,1,1-Trichloroethane - Limit and monitoring deleted because: 1) Parameter was put in permit in early to mid-1980's, with an unknown basis; 2) There has never been an issue with monitoring or limit; and 3) Monitoring data is all ND. Antimony, Total - Limit and monitoring deleted because: 1) Parameter was put in permit in early to mid-1980's, with an unknown basis; 2) There has never been an issue with monitoring or limit; and 3) Monitoring data is all ND. Cadmium, Total - Limit and monitoring deleted because: 1) Parameter was put in permit in early to mid-1980's, with an unknown basis; 2) There has never been an issue with monitoring or limit; and 3) Monitoring data is all ND. Chromium, Total - Limit and monitoring deleted because: 1) Parameter was put in permit in early to mid-1980's, with an unknown basis; 2) There has never been an issue with monitoring or limit; and 3) Monitoring data is all ND. Chloroform, Total - Limit and monitoring deleted because: 1) Parameter was put in permit in early to mid-1980's, with an unknown basis; 2) There has never been an issue with monitoring or limit; and 3) Monitoring data is all ND. Total Mercury - Monitoring using Method 245 is eliminated. Replaced with monitoring using the more sensitive EPA Method 1631, with a limit of 30 ng/l DM. Oil & Grease - A limit of 15 mg/l DM has been added to the permit. The modification also includes several other minor reporting modifications. The Rome Municipal Sewage Treatment Plant has surface discharge into the Mohawk River, Erie Barge Canal, a class C water. Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jan 25, 2008.
