The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 002-5739, DEC Identification #: 4-0122-00006/00002-0), the Town of Bethlehem Cedar Hill Water Pollution Control Plant pursuant to 6 NYCRR Part 750- 1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The changes to the permit are as follows: Overflow at 43 Rockefeller Road pump station - The SSO at this station has been removed from the permit because no overflow history has been recorded for the past five years and no overflow structure exist. The facility has two wet weather retention tanks at this location which serve to store wastewater during storm event. The wastewater is pumped back to the line after the event using portable pump. Outfall 001 - Flow - Daily Maximum monitoring is added. PH - The monitoring frequency is increased from twice per day to three times per day based on TOGS 1.3.3 Appendix A. BOD. 5. -The monitoring frequency is increased from once per week to twice per week based on TOGS 1.3.3 Appendix A. BOD. 5. - Daily Maximum monitoring is added. BOD. 5. Percent Removal - Daily Minimum Percent Removal monitoring is added. TSS - The monitoring frequency is increased from once per week to twice per week based on TOGS 1.3.3 Appendix A. TSS - Daily Maximum monitoring is added. TSS - Percent removal is increased from 75% to 85% based on the past history of DMR. TSS Percent Removal - Daily Minimum Percent Removal monitoring is added. Solids, settleable - The monitoring frequency is increased from twice per day to three times per day based on TOGS 1.3.3 Appendix A. Solids, settleable - Monthly Average monitoring is added. Temperature - The monitoring frequency is increased from twice per day to three times per day based on TOGS 1.3.3 Appendix A. Temperature - Monthly Average monitoring is added. Ammonia, (NH. 3. ) - Ammonia monitoring has been removed from monitoring schedule based on the past history of DMR data. Mercury - Short term monitoring is added to the permit due to significant detection in the effluent flow. Fecal Coliform - Daily Maximum monitoring is added. Chlorine, Total Residual - Monthly Average monitoring is added. The modification also includes several other minor reporting modifications. The Town of Bethlehem Cedar Hill Water Pollution Control Plant has surface discharge into the Hudson River, a class C water. Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

The Department has proposed an Air State Facility Permit for the application that was received for the SABIC Noryl US LLC facility located on 1 Noryl Ave., Town of Bethlehem, County of Albany, owned by SABIC Noryl US LLC, 3035 1 Noryl Ave., Selkirk, New York. The facility manufactures plastic materials, resins and processes industrial organic. The company proposes to install a new, more efficient emissions control scrubbing system in order to come into compliance with most recent applicable air regulations. The new system would combine the emissions from ten separate sources (tanks and columns) and vent them to a more efficient scrubber system, then vent to an emission point. The applicable regulations are found in 40 CFR 63 Subpart FFFF and 40 CFR Subpart 63 SS.
Persons wishing to inspect the subject Air State Facility files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative below. It is recommended that an appointment be made to confirm the availability of the subject files. The DEC will endeavor to make the files available within two business days of contact, during normal business hours (8:30 AM through 4:45 PM), unless the requestor wishes to inspect the files at a later date. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. A public hearing may be legislative or adjudicatory. A legislative public hearing is a proceeding which provides an additional opportunity for public comment. DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists. If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments. The applicant and all persons who have filed comments on the permit will be notified by mail of the public hearing. Comments and requests for a legislative hearing should be in writing and addressed to the Department representative listed below.

An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination. An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exists. A copy of the Department's permit hearing procedures is available upon request or on the Department's web site at: http://www.dec.ny.gov/permits/6234.html.

Comments will be received for 30 days from the date of this notice. If comments are received which raise significant issues or provide additional relevant information, the Department may modify the draft Air State Facility Permit.

As compensatory mitigation for wetland impacts 3.90 acres of new wetland area will be created and 1.45 acres of existing wetlands will be enhanced. Project Description: LB Furniture Industries, LLC has applied to the department for a new Air State Facility Permit. This permit application includes proposed conditions for manufacturing and finishing of wood and metal furniture.
Metal furniture manufacturing includes cutting, welding, grinding, polishing and powder paint coating. The particulate emissions generated are controlled by a fabric filter venting back into the facility. Powder painting does not have an emission point, and overall is considered an exempt activity as per 6 NYCRR Part 201-3.2. Wood furniture manufacturing includes cutting, sanding, assembly and finishing. The particulate emissions generated by cutting and sanding operations are controlled by a cyclone device and fabric filter venting back into the facility. Finishing includes stain and coating operations. Finishing work is done in paint booths equipped with fabric filters.
The facility also operates various 6 NYCRR Part 201 exempt sources including; propane fired heaters, ovens and welding stations. The facility is subject to the rules and requirements of 6 NYCRR Parts 288 and 212 and, 40 CFR Part 63. Volatile organic compound and hazardous air pollutants are limit to 49 and 12.5 tons/year respectively.

The Department has prepared a Draft Permit and has made a tentative determination to approve this application.
Project Location: The existing facility is located in the City of Hudson at 99 South 3rd Street, Columbia County.
