Project Description:

The Department has made a tentative determination to issue a modification and renewal of an existing SPDES permit for the former Agrilink/Birdseye Foods Oakfield facility food processing plant which discharges treated food processing wastes from aeration lagoons to spray fields and discharges treated food processing effluent from the on-site wastewater treatment plant and non-contact cooling water to tributarys of Oak Orchard Creek (one tributary is just south of Allens and the other is west of Allens and is tributary which originates at the US Gypsum plant). The changes include the permit transfer to Allens Inc.; the elimination of sprayfield and in-stream monitoring of some parameters due to extensive, consistent data which verifies protection of the environment; and other administrative changes. As a tentative determination, the Department seeks comments prior to making a final decision on permit issuance. The file is available for review and comment at NYSDEC Region 8.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
