The New York State Department of Environmental Conservation (NYS DEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.

NYS DEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYS DEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Dutchess County - The Town of Red Hook Planning Board, as lead agency, has determined that the proposed Agra Gate, LLC Lot Line Alteration will not have a significant adverse environmental impact. The action involves the conveyance of 6.0 ± acres of land from a 131 ± acre parcel to a 5.0 ± acre parcel in the Limited Development Zoning District. The project is located on Stony Brook Road in the Town of Red Hook, New York.

Dutchess County - The Village of Wappingers Falls Planning Board, as lead agency, has determined that the proposed Market Properties Lot Consolidation will not have a significant adverse environmental impact. The action involves the consolidation of three (3) existing lots into a single 21 ± acre parcel. No construction is proposed. The project is located in the Market Street Industrial Park in the Village of Wappingers Falls, New York.

Dutchess County - The Village of Wappingers Falls Planning Board, as lead agency, has determined that the proposed McCormick Subdivision will not have a significant adverse environmental impact. The action involves the subdivision of an existing 2.018 ± acre parcel into two (2) residential building lots. The lots will be served by municipal sanitary sewage disposal and water supply systems. The project is located on Hillside Avenue in the Village of Wappingers Falls, New York.

Dutchess County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Shenandoah Farms, New Mining Application will not have a significant adverse environmental impact. The action involves the proposal to mine approximately 600,000 tons of sand and gravel from 23.8 acres of an approximately 250 acre dairy farm over the course of ten years, with no more than 5 acres affected and unreclaimed at any given time. The current slopes limit agricultural use of these fields. The proposed reclamation objective for the site is a return to agricultural land with more even slopes. No excavation below the water table is proposed. No material processing on site is proposed. The project is located at 4269 Jackson Road in the hamlet of Shenandoah, Town of East Fishkill, New York.

Dutchess County - The Town of Milan Town Board, as lead agency, has determined that the proposed Local Law #7 of the Town of Milan Freshwater Wetlands Watercourse Protection Law will not have a significant adverse environmental impact. The action involves the proposal of a Local Law to establish a new chapter in the Town Code which creates regulations for the protection of wetlands and watercourses, as an implementation measure recommended in the Town of Milan Comprehensive Plan. The purpose of the Local Law is to regulate the dredging, filling, deposition or removal of materials; the diversion or obstruction of water flow and the placement of structures in, and other uses of the ponds, lakes, reservoirs, natural drainage systems and wetlands located in the Town of Milan. The law outlines which acts are prohibited, which require a drainage permit and those that are exempt. It also establishes a permitting procedure and definitions associated with the regulations. The project is located in the Town of Milan, New York.

Extension of Public Scoping Deadline

Ulster County - The New York State (NYS) Department of Environmental Conservation (DEC), as lead agency, has extended the deadline for submission of written comments on the scope of the Draft Supplemental Environmental Impact Statement (DSEIS). The SDEIS is being prepared for:

1) a proposed modified resort development adjoining the Belleayre Mountain ski center;
2) State unit management plan amendments for the ski center; and
3) certain land acquisitions by NYS.

Written comments will now be accepted until January 14, 2008. Comments may be submitted by mail to the contact person below, or by email to wildacre@gw.dec.state.ny.us (Please make sure that the subject line includes the term "Scoping".)

The positive declaration and original scoping notice were issued on November 21, 2007, see http://www.dec.ny.gov/enb/20071121_not3.html and http://www.dec.ny.gov/enb/20071121_not4.html. The project is located in the Towns of Shandaken (Ulster County) and Middletown (Delaware County), within the boundaries of the State of New York's Catskill Park and also within City of New York's Catskill and Delaware Watershed. The project site is south of NYS Route 28, generally between the Village of Fleischmanns and the hamlet of Big Indian.
