Project Description:

The Department has made a tentative determination to approve this request, made pursuant to Consent Order R2-20070316-129, for the modification of an existing SPDES permit for an existing discharge of treated stormwater and wetland overflow into Old Place Creek (Class SD) and Prall's Creek (Class SD) and an existing discharge of treated sanitary wastewater to groundwater from a septic system located at the main office building. The site is located at 500 Western Ave in Richmond County, NY. The existing SPDES permit was written for past activities on the site, i.e., for stormwater runoff from an oil tank farm. The Department entered into a consent order with the permittee, requiring the removal of contaminated fill, site stabilization, and modification of the SPDES permit to reflect current operations at the site. Removal of the contaminated fill is ongoing. Stormwater runoff sitewide, including from areas where contaminated fill is being removed and from proposed construction activities, will be regulated by this proposed permit.
Compared to the existing permit that this modified permit will replace, the following significant changes are proposed: 1) Updated permit pages are used, based on current Department guidance, format and nomenclature. These include a page of definitions. 2) Limits and Action Levels - Lead action level was removed from permit; action levels for benzene, toluene, ethylbenzene and methyl tert butyl ether (MTBE) were reduced; a copper action level has been added; and a total suspended solids limit of 50 mg/l was added to the permit. 3) Compliance schedules - Monitoring of wetland overflows is required once per month for a period of one year to determine whether significant levels of pollutants are discharged from the wetlands; monitoring of the discharge of 3 of the sediment basins is required for a period of one year to determine whether the sediment basins are effectively removing total suspended solids and turbidity; and the permittee is required to develop a new Best Management Practices Plan.
