The Department has made a tentative dsetermination to re-issue permit (NY 0128023) and has prepared a draft permit which would allow the discharge of up to 2,500 gallons per day of treated wastewater from an on-site wastewater treatment system with surface discharge to Little Brokenstraw Creek. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought. When commenting, please refer to this application by both the application number and the SPDES number listed in this notice. A draft permit and application materials are available for inspection/review in the Region 9 Buffalo Office.

Project Description:

The applicant proposes to construct a roundabout within New York State Wetland BU-7 and its regulated 100 foot wide adjacent area. This roundabout is located along the east side of NY Route 5 at the intersection of Tifft Street at the on and off ramps. Approximately 0.02 acres of fill is required to be placed within the wetland boundary and 0.08 acres of additional fill is required to be placed within the 100 foot wide adjacent area.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
