The stream flowing through the culverts is a tributary of the Wappengers Creek, Stream/ Waterbody Index: H- 101-1.0, (Class B(ts)). The disturbance of the stream bed and banks is estimated to be 510 square feet. A SPDES General Permit for Construction Activities is also required as the land disturbance is anticipated to be 2.9 acres.

The applicant proposes to apply the aquatic pesticide Cutrine Ultra (active ingredient: elemental copper) to approximately 48.5 acres of Cranberry Lake. The purpose of the proposed treatment is to control the growth of nuisance algae. The sponsor currently has a valid Article 24, Freshwater Wetlands Permit and Part 327 Aquatic Pesticide Permit to apply the pesticides Sonar AS (active ingredient: fluridone) and AquaPro (active ingredient: glyphosate) within additional areas of Cranberry Pond for the control of floating and submerged aquatic vegetation. A 200-foot separation will be maintained between the chemical treatment areas and State-designated Freshwater Wetland SL-5 (Class II).

Project Description:

The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and made a tentative determination to issue a modification to the Title V Air Facility Permit for the initial preconstruction and operation of Algonquin Stony Point. By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit. The facility is making changes to its Turbine Replacement Project. The facility is replacing the two existing Solar Centaur 40-4700 compressor turbines with two Solar Taurus 60-7800 compressor turbines. The facility has determined there is no need to rebuild the existing Solar Mars 90-12000 turbine to a Solar Mars 100-15000 that it proposed previously. Facility is also not replacing the existing boiler. The modification involves limiting the NOx emissions of the new Solar Taurus turbines to 30.7 tons per year. The turbines will be natural gas fired and the usage of natural gas will be continuously monitored.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. This application was previously published with a proposal for treatment of 0.185 acres.
