The New York State Department of Environmental Conservation (NYS DEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.

NYS DEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYS DEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Notice of Acceptance of Final GEIS

Erie County - The Town of Amherst Town Board, as lead agency, has accepted a Final Generic Environmental Impact Statement on the proposed Change in Use Classification for the Proposed Muir Woods Multi-Use Development. The action involves the Amendment #51 to the Audubon Development Plan which requires the change in use classification from NCD-ND & NCD-MOS to NCD-GC, NCD-RI & NCD-MOS for the proposed multi-use development, "Muir Woods", to consist of a commercial/office/research & development/retail complex with an integrated residential development. The property to be reclassified measures 181.36 ± acres and is currently vacant with brush, wooded areas, lake and State and federal wetland areas. The entire property proposed for the Muir Woods development measures 326 ± acres. The project is located at 1081 and 1121 North French Road in the Town of Amherst, New York.
