DEC has made a tentative determination to re-issue/re-new this pre-existing permit for a five year term with updated regulatory requirements and maintaining current effluent limitations and monitoring and reporting requirements. Project Description:

The Department of Environmental Conservation (DEC) has received an application to modify the following Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit. This permit was originally issued in 1989 for construction of a wastewater treatment plant (WWTP) with a discharge capacity of 250,000 gallons per day of sanitary waste. The WWTP and was intended to serve the Davos in the Woods subdivision. The subdivision and the WWTP were partially completed. The WWTP was taken off line a short time later and waste from homes that were constructed was diverted to a separately permitted WWTP. This permit transaction is pursuant to the request of the permittee to initiate further construction of the subdivision and the associated WWTP, resuming a previously authorized discharge. The draft permit authorizes a surface discharge through a biodisc, package-style WWTP of up to 250,000 gallons per day of sanitary waste to the Neversink River. The WWTP is expected to be brought on line in increments of 100,000 GPD, as dictated by subdivision construction. The SPDES permit contains both interim and final limits. On 27 August 2007, the Town of Fallsburg provided documentation to DEC affirming that current subdivision and WWTP plans are consistent in their opinion with the original State Environmental Quality Review preformed in 1988 for this project as a whole.
