The New York State Department of Environmental Conservation (NYS DEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.
NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.
Please note the application package includes the Draft Remedial Investigation / Alternatives Analysis Report Work Plan which describes the remedial activities to be conducted to investigate and determine the nature and extent of the contamination related to the site.
NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Allegany and Cattaraugus Counties - The Town of Cuba Town Board, as lead agency, has determined that the proposed Cuba Lake Wastewater Collection System will not have a significant adverse environmental impact. The action involves the Town of Cuba's and the Town of Ischua's intent to construct a wastewater collection system to serve properties along the perimeter of Cuba Lake and the area between the lake and the Village of Cuba. The project is located along NY State Route 305 in the Towns of Cuba and Ischua, New York.

Erie County - The Town of Sardinia Zoning Board of Appeals, as lead agency, has determined that the proposed Application for a Use Variance by Gernatt Asphalt Products, Inc. to conduct mining on the Thompson / Gabel site will not have a significant adverse environmental impact. The action involves the mining of sand and gravel with a material processing plant including crusher, scree, conveyors and close loop water circulation system of 350 acres of land with excavation below ground water table up to 275 acres. All operation on the site will be conducted in accordance with the New York State Department of Environmental Conservation (NYS DEC) MRL Permit No. 9-02930. The proposed project was the subject of comprehensive coordinated environmental review by NYS DEC acting as lead agency and resulted in the preparation of a DEIS, FEIS, SEIS as well as several decisions by the Commissioner of NYS DEC following adjudicatory hearings. NYS DEC completed its SEQRA review in 1995. At the time the NYS DEC completed it SEQRA review, no approvals or actions were required by the Town of Sardinia ZBA. The project is located on Route 16 in the Town of Sardinia, New York.

Notice of Acceptance of Draft EIS
Erie County - The Town of Clarence, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Clarence Hollow Pollution Abatement Project / Spaulding Green Subdivision Portion. Written comments on the Draft EIS will be accepted until October 31, 2007. A copy of the Draft EIS can be obtained from the contact person listed below. The action involves the applicant, Spaulding Green, LLC, proposal to construct approximately 380 units of single-family housing on 419 acres of land. Specifically, 64 units of townhomes, 62 units of patio homes, and 254 units of standard single-family home sites. The project sponsor is proposing to utilize the Town's Open Space Design Overlay District to protect 50% of the land (209 acres) in perpetuity in exchange for the reduced lot sizes for the residential housing. The project is located between Clarence Center Road to the north, Kraus Road to the east, Greiner Road to the south and Goodrich Road to the west in the Town of Clarence, New York.
