Project Description:

The Department of Environmental Conservation (DEC) has received an application to renew State Pollutant Discharge Elimination System (SPDES) # NY 016 8360, for Commercial Refrigeration Service Inc in Erie County. This is a pre-existing Private/Commercial/Institutional SPDES permit. DEC has made a tentative determination to renew this permit and set a standard five year term maintaining current effluent limitations and monitoring and reporting requirements. This permit involves the surface discharge of up to 200 gallons per day of treated sanitary waste into an intermittent tributary of Spring Brook, a class C(T) stream. Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Project Description:

The Department has drafted a permit and made a tentative determination to approve this application for renewal of SPDES Permit No. NY-0127906 for an existing discharge of up to 2,100 gallons per day of treated sanitary wastewater from a septic tank/sand filter system into a tributary of Pike Creek at the applicant's apartment complex. Project Description:

The applicant proposes to install new stepped back rock riprap shoreline protection with bioengineering plantings, to control erosion along the shoreline along his 500 foot wide property on Lake Ontario. The shoreline has been hardened in the past by previous owners and the bluff was also regraded to reduce its slope. Permission has been given by the adjoining property owners (Town of Porter and New York State Parks Western Region - Fort Niagara State Park) to extend the shoreline protection across property lines to prevent erosional flanking. A 30 year maintenance plan for the project was submitted as part of the application. In addition, a drainage swale/gully will be protected with stone to prevent continuing erosion.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
