Project Description:

The application involves two sites along Fulmer Creek (T-German Flatts, Herkimer Cty) in close proximity to each other.
Site one will consist of restoration of approximately 300 feet of stream channel through construction of a two-tier stone retaining wall and a final tier of large rip-rap. The two stone layers will be constructed from large stone no less than 500 pounds each and keyed and/or pinned into the bedrock. The upstream end of the wall will be keyed into the existing bank while the downstream end will be tapered into the bank with heavy rip-rap. The slope of the retaining wall will not exceed 1' vertical to 1.5' horizontal.
Site two involves realignment of the existing stream channel. Due to heavy bed load deposition, high flows are eroding the southern bank of the stream. A new channel will be constructed through an existing gravel bar thus moving the channel northward. The new channel will be dug in the dry beginning at the downstream end. Excess excavated material will be used either as back fill at a local trailer park or placed over the eroded southern bank and covered with heavy stone. A flow deflector will be build on the southern bank on the the upstream terminus of the new channel to redirect flows so as not to cause additional erosion. Habitat enhancements will be incorporated through placement of boulders within the new stream channel.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 002 0486, DEC Identification #: 6-2130-00017/00001), the Village of Herkimer Wastewater Treatment Plant pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The changes to the permit are as follows: Add reference to outfall 003. Update DMR responsible official and add prohibitions. Eliminate effluent limits and monitoring requirements for Cadmium at outfall 001. The contributing industry has gone out of business. Add effluent limits and monitoring requirements for the overflow retention facility. Eliminate actions levels and monitiroing requiremnts for Chromium, Nickel, Silver, Copper, Zinc, Lead and Mercury at outfall 001. The contributing industry has gone out of business. Add monitoring locations map. Eliminite pretreatment mini program requirements. There are no longer any industrial contributions to the sanitary system. Add special conditions for the overflow retention facility. Add capacity, management and operation and maintenance plan requirements. Eliminate toxicity testing program. The closing of the industrial contributor has negated this necessity. Add schedule of compliance. Add discharge notification requirements. Update NYSDEC address. The modification also includes several other minor reporting modifications. The Village of Herkimer Wastewater Treatment Plant has surface discharge into the Mohawk River, a class B water. Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
