The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Amended Negative Declaration

Dutchess County - The Town of Rhinebeck Planning Board, as lead agency, has determined that the proposed William and Susan Koff Minor 4-Lot Subdivision will not have a significant adverse environmental impact. The action involves the grant of Subdivision Plat Approval by the Town of Rhinebeck Planning Board and related permits, approvals and compliance determinations from other involved agencies to authorize the creation of a 19.033 acre existing house lot and three residential building lots of 5.000 acres, 20.000 acres and 6.55 acres, respectively. These lots will be develped at a future date by individual single family residential dwellings from a 50.588 acre parcel situated in the R5A Zoning district, the Hudson River National Historic Landmark and Mid-Hudson Historic Shorelands Districts, and Estates District Scenic Area of Statewide Significance, being a tract of land previously subdivided from the Ferncliff Estate.. The project is located at 167 River Road, with frontage on west sides of River Road and Ryan Roads in the Town of Rhinebeck, New York.

Westchester County - The Town of Greenburgh Town Board, as lead agency, has determined that the proposed Local Law adopting the Westchester County Greenway Compact Plan, The Greenprint for a Sustainable Future...the Westchester Way will not have a significant adverse environmental impact. The action involves the adoption of Westchester County Greenway Compact Plan under the provision of Section 44-0119 of the Environmental Conservation Law of New York State. To include amendment of Zoning Ordinance and Subdivision Regulations so as to make reference to the Compact Plan and direct reviewing agencies to consider the Compact Plan's policies in discretionary action under those laws, as appropriate. The project is located in the Town of Greenburgh, New York.

Positive Declaration

Orange County - The Town of Crawford Planning Board, as lead agency, has determined that the proposed Wolfe Rock may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves a requested 154-unit residential townhouse development, based on a total of 278 "as of right" bedrooms arrayed in 139 2-bedroom units, with up to an additional 16 2-bedroom units of incentive density, in exchange for certain proposed improvements and payments relating to the development of an onsite water supply with appurtenances and its dedication to the Town. The site would have two access points, each of which leads to separate roads: Edmunds Lane, a town road that becomes Hill Street and dead-ends near the Shawangunk Kill, and NYS Route 302. The site has a 50-foot strip of frontage on NYS Route 302 that is off-set just south of the intersection of NYS Route 302 and Stockmarket Road; the project plans propose an easement on lands just north of the site (owned by the Roman Catholic Church of the Infant Savior), in order to form a properly aligned 4-way intersection with Stockmarket Road and 302. The project is located on Edmund Lane and NYS Route 302 at the Town of Shawangunk boundary in the Town of Crawford, New York.

Orange County - The Town of Goshen Town Board, as lead agency, has determined that the proposed Text Amendments to the Town of Goshen Zoning Law may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. A public scoping session will be held on October 11, 2007 at 7:30 p.m. at the Town Hall Meeting Room at the Goshen Town Hall, 41 Webster Avenue, Goshen, NY. The action involves the text amendemnts to the Town of Goshen Zoning Law Sections 97-1 to 20. The changes incorporated only involve those sections of the Zoning Law. The project is located Townwide in the Town of Goshen, New York.

Notice of Acceptance of Draft EIS and Public Hearing

Westchester County - The Town of Mount Pleasant Planning Board, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Mountainview at Valhalla. A public hearing on the Draft EIS will be held on November 11, 2007 at 8:00 p.m. at the Town of Mount Pleasant Town Hall, One Town Hall Plaza, Valhalla, NY 10595. The action involves the construction of a 46 unit age-restricted cluster development. The project is located on Virginian Road and Route 100, Valhalla, Town of Mount Pleasant, NewYork.

Dutchess County - The Town of Wappinger Town Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Adoption of Town Comprehensive Plan and Associated Zoning Changes. The action involves the adoption of a new Town Comprehensive Plan and associated zoning changes. The project is located in the Town of Wappinger, New York.

Notice of Acceptance of Final SEIS

Orange County - The Town of Monroe Planning Board, as lead agency, has accepted a Final Supplemental Environmental Impact Statement on the proposed Bald Hill Estates. The action involves a request for a site plan and special use permit approval for a townhouse unit multiple dwelling group, plus a subdivision of light industrial lands effectuated by the proposed road pattern. The FEIS includes two sets of plans - the SEIS Plan which proposed 112 townhouse units and Alternate #3 from the SEIS which proposed 138 units. Both layouts include a subdivision of three commercial / LI zoned lots. The 112 unit plan proposes two access points on CR 105. The 138 unit plan proposes a new access into the site via an extension of Larkin Drive, and this proposal would eliminate the southerly site access to CR 15 from the SEIS plan. The project includes a proposal to connect to a central water supply and develop a distribution system to serve the use and the site is seved by central sewers.
