Project Description:

The applicant proposes to change water levels affecting state regulated freshwater wetlands located adjacent to Miner Lake as part of the proposed rehabilitation and reconstruction of the McGregor Dam. The existing concrete gravity (Ambursen) dam is located on the Great Chazy River, approximately one half mile north (downstream) of NY Rte. 190. The McGregor Dam was breached in 2006 and a temporary spillway was installed at elevation 790.0'. The proposed reconstruction will establish a spillway elevation of 807.8', which is approximately one foot lower than the previous spillway elevation. Hydrology will be altered in the class 2 freshwater wetlands designated as J-1 and J-9 when the impoundment is reflooded after the dam work is complete. The proposed work on the dam is designed to meet all current applicable regulatory requirements.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Oct 19, 2007.
