Project Description:

Applicant is proposing to develop a 35-lot residential subdivision on an approximately 127 acre property. The proposed single-family lots will range from 2 to 14.5 acres in size. The lots will have individual wells and septic systems. Construction of the residential subdivision will result in permanent impacts to approximately 0.25 acres of regulated federal wetlands, 0.03 acres of NYS Freshwater Wetlands and 0.02 acres of NYS Freshwater Wetlands Adjacent Area. Mitigation for the proposed impacts to wetlands includes a monetary donation to the Columbia Land Conservancy. The applicant is also proposing to deed restrict remaining wetlands on the property.
The project site is located south of Schneider Road in the Town of Livingston, Columbia County, New York.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Livingston Town Planning Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Albany Port District Commission proposes to modify their existing maintenance dredging permit to allow for the disposal of dredge material at an historic dredge disposal site located in the Town of East Greenbush and owned by the State Office of General Services. The disposal site is located east of the Hudson River off of Riverside Avenue Extension just south of the Gold Bond Facility. Disposal includes the deposition of approximately 8,500 cubic yards of material from the Port of Albany and 1,350 cubic yards of material from Rensselaer Port. Levels of contaminants are low (4-7 ppm PCBs), and stringent environmental controls will assure protection of water quality, aquatic and terrestrial species, and containment of the dredge spoils within the disposal area. There will be no discharge from the disposal area. An existing concrete structure and earthen berm located in a state regulated freshwater wetland will be temporarily modified to provide access to the disposal location which is not within the state regulated wetland. Upon completion, the stabilized dredge spoils will be covered and revegetated, and the earthen berm at the point of access will be restored.
