The applicant proposes to construct within 24" of the existing bulkhead 88 linear feet of bulkhead, remove and replace in the same location 95 linear feet of bulkhead, install a 6 ft. return on east end, raise the elevation of all new bulkheading 18", dredge 10 ft. seaward of the bulkhead to a maximum depth of 4 ft. below mean low water with resultant 25 cubic yards of dredged material and 50 cubic yards of upland fill used as backfill. Replace 6 ft. wide capping boardwalk. Property is located at 358 Arthur Street, Freeport, Town of Hempstead, County of Suffolk, on Woodcleft Basin.

Project Description:

Safety Kleen Systems, Inc., ("Safety Kleen ") formerly Safety Kleen Corporation, is a solvent distributor and recycler (reclaimer). Its customers are primarily engaged in automotive repair, industrial maintenance and dry cleaning. The company offers spent solvent collection and reclamation. The facility operates under the state 6 NYCRR Part 373 hazardous waste management permit issued on 9/8/2003. The area is zoned for commercial use and the facility is located in a business/industrial area approximately one half mile south of the Wellwood Avenue exit off the Southern State Parkway. A majority of this facility's customers generate less than 1000 kg (2200 lbs) per month of hazardous wastes. Wastes managed by Safety Kleen Systems are transported in its transport vehicles to one of Safety Kleen's Recycle/Process Centers or to contract reclaimers located outside New York State. In many instances the recovered materials are returned to customers as usable product.
Safety Kleen submitted to the New York State Department of Environmental Conservation ("Department") a Notice of Intent to Close this facility on November 1, 2006 to discontinue its hazardous waste operations under its existing 6 NYCRR Part 373 Permit. However, Safety Kleen plans to convert the facility for managing used oil under a 6 NYCRR Part 360 Permit and temporarily store hazardous wastes incidental to transportation not exceeding 10 days in accordance with the U.S. Department of Transportation (DOT) Regulations exempted from the Federal and State hazardous waste regulations.
The closure plan in the existing permit was for final closure of the facility which required cleaning and razing of the secondary containment, backfill excavation with clean-fill, removal of tanks and structures and offsite disposal. Since these units will be reused and left in place more extensive onsite cleaning and verification are required for approval of closure and reuse of the facility. This requires extensive revisions to the approved closure plan in the permit. Safety Kleen resubmitted the closure plan on February 21, 2007 and it was reviewed and updated through August 2007. The Department has tentatively determined that the resubmitted closure plan is acceptable.
The last shipment of hazardous waste received at the facility was December 1, 2006 and the facility is required by the permit to complete the closure within 180 days of this date. Because of unforeseen reasons the facility was not closed within this time allowed and Safety Kleen has requested an extension for final closure time.
The Department determined that these revisions are major modification under the provisions of 6 NYCRR Part 6 NYCRR Part 373-1.7(c)(15) and 373-1.7(d)(1)(i) . This will be processed under State Uniform Procedures 6 NYCRR Part 621.14(c).
