Alleghany County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Harris Gravel Pit will not have a significant adverse environmental impact. The action involves the mining of sand and gravel and material processing with a portable dry-screen and crusher, each with a maximum capacity less than 150 tons per hour, on 3.5 acres of land out of 49.2 acres owned by the applicant at the site. Proposed access (haul road) is an existing farm road from Allegany County Route 15 (CR 15). The estimated life of the mine is 5 years and the reclamation objective is agriculture. The project is located on the east side of CR 15, and 750 feet south of CR 15A (a.k.a. Fink Hollow Road and Basswood Hill Road), in the Town of Allen, New York.

Erie County - The City of Buffalo Planning Board, as lead agency, has determined that the proposed Gates Circle Condominiums will not have a significant adverse environmental impact. The action involves the construction of a concrete framed, 23-story approximately 155,000 square foot luxury condominium building with 123 underground parking spaces. The project is located at 25 Gates Circle (formerly known as 33 Gates Circle), Buffalo, New York.

Re-Issue to a Negative Declaration
Niagara County - The Town of Wheatfield, as lead agency, has determined that the proposed Wheatfield Lakes Patio Homes will not have a significant adverse environmental impact. The action involves the development of 79 patio homes on 32.7 acres within the existing Wheatfield Lakes Planned Unit Development (PUD). The project includes the construction of two private streets accessing Lakeside Drive. The site contains both federal and state regulated wetlands along Black Creek on the south portion of the property. This action involves a modification to the original Wheatfield Lakes PUD rezoning and review of the subdivision plan. The project is located in the Town of Wheatfield, New York.

Notice of Acceptance of Draft EIS and Public Hearing
Erie County - The Town of Grand Island, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Country Club Cottages. A public hearing on the Draft EIS will be held on October 1, 2007 at 8:00 p.m. at the Town Hall Chambers, 2255 Baseline Road, Grand Island, NY 14072. Written comments on the Draft EIS will be accepted until 5:00 p.m. on October 11, 2007. The action involves the construction of a 67 unit residential subdivision on 28.5 ± acres of land utilizing cluster regulations. The project is bordered by Fix, Baseline and Fairway in the Town of Grand Island, New York.
