BROWNFIELD CLEANUP PROGRAM

The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Allegany County - Allegany County, as lead agency, has determined that the proposed Establishment of Allegany County Sewer District No. 1 & County Water District No. 2 will not have a significant adverse environmental impact. The action involves the formation of two improvement districts by the County of Allegany: County Water District No. 2 and County Sewer District No. 1. The project is located in the Towns of Angelica & Amity, southeast of I-86 and east of CR 20/Route 19 intersection.

Niagara County - The Town of Porter Town Board, as lead agency, has determined that the proposed Town of Porter Zoning Law will not have a significant adverse environmental impact. The action involves the preparation and adoption of the Town of Porter Zoning Law to coincide with the recently adopted Comprehensive Plan to manage development while preserving agricultural land. The project is located in the entire community of the Town of Porter, New York.

Notice of Acceptance of Draft EIS and Public Hearing

Erie County - The Town of Hamburg Town Board, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Lowe's Home Improvement Center. A public hearing on the Draft EIS will be held on September 24, 2007 at 7:00 p.m. at the Hamburg Town Hall. A copy of the DEIS is on file at the Town of Hamburg Planning Department and the Town Clerk's Office, or can be viewed online at www.townofhamburgny.com. Written comments on the Draft EIS will be accepted until October 27, 2007. The action involves the construction of a 139,410 ± square foot Lowe's Home Improvement Center and accessory 31,659 ± square foot outdoor garden display area. In addition, two outparcels are proposed at the front of the site along Southwestern Boulevard that will each accommodate approximately 7,500 square feet of commercial uses such as banks, restaurants, retail, etc. The proposed project requires a rezoning of land from Single Family Residential - Attached (R-2) and Residential Multi-Family (R-3) to General Commercial (C-2). A Special Use Permit will be required for any building greater than 100,000 square feet in a C-2 zoning district. The project is located on the northeast corner of Southwestern Boulevard (US 62) and Sowles Road, immediately east of Oregon Road, in the Town of Hamburg, New York.

Niagara County - The City of North Tonawanda Plannnig Commission, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Wal-Mart Supercenter. A public hearing on the Draft EIS will be held on September 10, 2007 at 6:00 p.m. at the North Tonawanda City Hall, 216 Payne Avenue, North Tonawanda. A copy of the DEIS is available at the City Clerk's office, 216 Payne Avenue, North Tonawanda, NY or on the City's website at www.northtonawanda.org. Written comments on the Draft EIS will be accepted until September 21, 2007. The action involves the construction of a 185,312 ± square foot Wal-Mart Supercenter on 38 acres. The project also involves the demolition of the Melody Fair venue and Bluebird Coach Lines station and the creation of four separate outparcels. The project is located near the intersection of Niagara Falls Boulevard (US 62) and Erie Avenue (SR 425) in the City of North Tonawanda, New York.
