Project Location: Whiteface Mountain, Lower Northway Ski Trail, Essex County Town of Lake Placid.

Project Description: Whiteface Mountain Management is seeking DEC approval to complete Lower Northway Trail improvements as pre-approved in the 1996 UMP update and amendment. This project consists of widening the upper section of the designated area approximately 20 feet for a length of up to 300 feet. This project will require the removal of 2,016 trees larger than 3" diameter breast height over 0.7 acres. A review of the Natural Heritage information in the Master Habitat Database found no endangered or threatened animals, plants or communities located within the project boundaries. This notice is in compliance with the policy LF-91-2, Cutting, Removal or Destruction of Trees on Forest Preserve Lands. The New York Natural Heritage Program does not have any record of threatened or endangered species in the project area.

PROJECT DESCRIPTION: Construction of a new dock and modification of an existing dock to result in a 40' long, 65' wide dock complex with an open-sided boatcover/sundeck.


NOTICE OF COMPLETE APPLICATION: Applicant was notified by letter dated December 5, 2006 that the application was complete.

LAKE GEORGE PARK COMMISSION POSITION: The Commission determined that public comments received raised substantive and significant issues that could form the basis for denial of the application, specifically, that the project would have an undue impact on the health, safety and welfare of the public and cause undue visual, cultural and audible impacts on the neighborhood.

STATE ENVIRONMENTAL QUALITY REVIEW ACT ("SEQRA") DETERMINATION: The project is a Type II Action.

PUBLIC HEARING AND ISSUES CONFERENCE: A legislative hearing will be held to receive unsworn statements from the public on October 5, 2007 at 9:30 a.m. at the Bolton Town Hall, located at 4949 Lakeshore Drive, Bolton, New York.

All persons, organizations, corporations or government agencies that may be affected by the proposed project are invited to attend the legislative hearing and to submit oral comments. No prior filing is required to participate. However, the Administrative Law Judge may restrict the time available to 5 minutes for each person, to ensure that all persons will have an opportunity to be heard. It is recommended that lengthy comments be submitted in writing at the hearing. Written comments regarding this application may also be filed with the Office of Hearings at the address indicated below either before or during the legislative hearing. Equal weight will be given to both oral and written comments. The hearing location is fully accessible to persons with a mobility impairment. Interpreter services shall be made available to deaf persons, at no charge, upon written request to the Administrative Law Judge identified below, at least ten (10) business days prior to the hearing.

WRITTEN PUBLIC COMMENTS: All interested parties may submit written comments at the hearing or by mail no later than October 5, 2007 to Administrative Law Judge Molly T. McBride, NYS Department of Environmental Conservation, Office of Hearings and Mediation, 625 Broadway, 1st Floor, Albany, NY 12233-1550, with a copy to Michael White, Executive Director, Lake George Park Commission, 75 Fort George Road, Lake George, New York 12845.

ISSUES CONFERENCE: Pursuant to 6 NYCRR 645-6.6, a pre-adjudicatory issues conference will be held on October 5, 2007 immediately following the legislative hearing at Bolton Town Hall, 4949 Lakeshore Drive, Bolton, New York. The purpose of the issues conference is to define, narrow and if possible, resolve proposed adjudicable issues concerning the action which is being proposed. The Issues Conference may be canceled if no petitions for party status are timely filed.

FILING FOR PARTY STATUS: Party status to participate at the adjudicatory hearing will be accorded only to those persons who file a written petition requesting party status, pursuant to 6 NYCRR 645-6.4(b).

All petitions must be received by 4:00 p.m. on September 24, 2007. One copy of any petition requesting party status must be served upon the following individuals:

Negative Declaration

Fulton County - The Caroga Town Board, as lead agency, has determined that the proposed Adult Use Overlay Zone will not have a significant adverse environmental impact. The action involves the Adoption of Local Law #1 which was passed by the Town Board on March 14, 2007. The project is located in the Town of Caroga, New York.
