The applicant proposes to fill 0.46 acre of federally regulated wetlands to develop 11 townhouse buildings and associated appurtences within an approximately 14.34 acres parcel located on the east side of California Road, approximately midway between the intersections with Big Tree (US Route 20A) and Duerr Roads. As mitigation, the applicant will construct 0.94 acre of scrub/shrub and wet meadow wetlands.

Project Description:
The project sponsor, Noble Wethersfield Windpark, LLC, proposes construction and operation of a 127.5 megawatt (MW) wind power project consisting of up to 85 wind turbines, with 59 turbines anticipated in the Town of Wethersfield and 29 turbines anticipated in the Town of Eagle, both of Wyoming County, New York. The proposed project site involves land use of approximately 267 acres spread over an approximated 9151-acre project area (which does not include the overhead transmission line, substation, and switchyard).
The project also includes construction of approximately 20 miles of access roads, a 200-foot by 300-foot collection substation and a new switchyard with a 300-foot by 400-foot footprint, installation of 30 miles of buried 34.5 kV underground cable and 0.5 mile of overhead collection lines, and construction of 5.5 miles of overhead 230-kV transmission line.

State Historic Preservation Act (SHPA) Determination:
A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
