Negative Declaration

Cattaraugus County - The Village of Ellicottville, NY Board of Trustees, as lead agency, has determined that the proposed Local Law amending Section 3B of the Zoning Law, Land Use Table to permit Special Use Permit only in the VC-1 District certain apartments or condominium dwelling units and first floor commercial condominium units and also adding subsection 7A of Zoning Local Law Section 5 (Special Use Permits) will not have a significant adverse environmental impact. The action involves an amendment to the Zoning Local Law of 2005, to permit multi-dwelling units, including those defined as condominium units, be permitted to be established in the Village Commercial -1 (VC-1) zoning district. This amendment to the local zoning law involves a change in land use tables and zoning document text (Section 5) to include multi dwelling units as an allowable use in the VC-1 zoning district through Special (Conditional) Use Permit review and approval. As adopted, this amendment to the existing zoning codes will allow this new use to be applied throughout the entire Village Commercial-1 (VC-1) zoning distrcit under certain specified conditions. The project is located in the entire Village Commercial-1 (VC-1) Zoning District of the Village of Ellicottville, New York.

Erie County - The Town of Amherst Planning Department, as lead agency, has determined that the Proposed Drainage Plan Revision - 2785, 2795, 2799 & 2801 Hopkins Road will not have a significant adverse environmental impact. The action involves the approval of a revised drainage plan to serve the existing homes at 2785 and 2799 Hopkins and the proposed home at 2801 Hopkins. The property is directly adjacent to Ransom Creek. The project is located at 2785, 2795, 2799 & 2801 Hopkins Road, Amherst, New York.

Erie County - The Town of Amherst Town Board, as lead agency, has determined that the proposed Adoption of Dann Lake Park Comprehensive Plan will not have a significant adverse environmental impact. The action involves the proposal of a Comprehensive Plan which contains recommendations for developing, managing, maintaining and preserving the park which consists of 170 ± acres of mostly state and federal wetlands. A principal feature of the park is the 22-acre Dann Lake, a man-made body of water at the northern edge of the park. The Plan outlines proposed improvements to the park to include improving park access, installation of signage, construction of a gravel parking lot, and construction of naturalized hiking trails. The project is located at 10750 Transit Road, Town of Amherst, New York.

Erie County - The Town of Evans Town Board, as lead agency, has determined that the proposed Multi-Use Pathway will not have a significant adverse environmental impact. The action involves the design and construction of a multi-use pathway along the entire length of Lake Shore/Old Lake Shore Roads, to be constructed primarily in the public right-of-way. This pathway will vary in width and be constructed as either 5-foot paved roadway shoulders or 8-foot wide paved trail surface. This pathway will connect the various municipal parks along the Lake Erie shoreline and provide a linkage to pathways in neighboring communities. In total, the pathway includes over 13 miles of both on-road and off-road trail to be constructed in phases. The project is located on Lake Shore / Old Lake Shore Roads, Town of Evans, New York.

Notice of Acceptance of Final EIS

Wyoming County - The Town Board of the Town of Wethersfield, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Noble Wethersfield Windpark. The action involves the construction, operation and maintenance of a 127.5 MW wind energy facility consisting of 85 wind turbines (59 in the Town of Wethersfield and 26 in the Town of Eagle), along with associated access roads, electrical collection system and electrical substation. Each turbine will be approximately 400' tall when the blade is at highest point. The project is located in portions of the Towns of Wethersfield and Eagle, New York.
