Chemung County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Drilling Permit Application for Chesapeake Appalachia, LLC Proposed Bennett 1 Natural Gas Well located within Chemung County Agricultural District #03 will not have a significant adverse environmental impact. The action involves the drilling of a natural gas well in the Town of Erin, located within Chemung County Agricultural District #03. Drilling operations will be conducted in accordance with the drilling permit issued and rules and regulations of the Department. The total area proposed to be disturbed during the initial construction phase for the well site and access road is 198,925 square feet or approximately 4.6 acres. After the well has been drilled, it will be put into production or plugged and abandoned. The well pad and access road areas for a producing well will be reduced to 41,450 square feet or approximately 0.95 acres and the remaining disturbed areas reclaimed. If the well is plugged and abandoned, the site will be reclaimed. The project is located approximately 1,600 feet east of Chapman Road and 1,900 feet south of Thayer Road, in the Town of Erin, New York.

Positive Declaration and Public Scoping
Steuben County - The Town of Bath Planning Board, as lead agency, has determined that the proposed Wal-Mart Supercenter may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until the date of the scoping session. A public scoping session will be held on August 23, 2007 at 7:00 p.m. at the Civic Defense Building, SR 54, Bath, NY. The action involves the construction of an approximately 156,389 square foot Wal-Mart Supercenter on a 19.2 acre site, including 787 parking spaces, lighting, landscaping, etc. Project will include the conversion of approximately 17.9 acres of brushland/meadow to paved surfaces and buildings, the generation of 880 vehicle trips per hour and the extension of water, sewer and other utilities. The project is located on NYS Route 54, Town of Bath, New York.
