Project Description:

The applicant proposes to develop and operate a new 25 acre topsoil and sand and gravel mine on a 176 acre farm in the Chemung River Valley. The project site is the applicant's property located on State Route 352 in the Town of Big Flats, Chemung County. The mine is located within the floodplain of the Chemung River approximately 200 ft from the River. The mine is intended to operate as a traditional surface extraction of topsoil and sand and gravel. Excavation will be done by mechanical equipment, standard for sand and gravel mining operations, and for removal of material below the water table. The mining operation will include dry mining of topsoil and gravel by a loader or excavator, and once the water table is reached, with a dragline or excavator to a depth of 50 feet. Material will be sold as unprocessed "run-of-bank" or processed with portable equipment. No stockpiles will be created in the life-of-mine area. Mining will only occur during dry periods, late spring to early fall in order to avoid flooding of the mining operation. Final reclamation will restore the site to a shallow water wetland surrounding a deeper pond. Upland reclamation will include the replacement of stockpiled topsoil, and reseeding with an approved USDA SCS seed mixture. The reviewed life-of-mine area is 25 acres.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

The applicant is proposing the placement of stone rip rap at the toe of the Edgemere Drive embankment in an effort to control erosion along Long and Buck Ponds. Approximately 575 cubic yards of stone will be placed along approximately 560 feet of shoreline on Long Pond and 700 feet of shoreline on Buck Pond.

The applicant proposes to extend the armor stone revetment an additional 175 lineal feet along the shoreline of Lake Ontario on his property located at 8085 East Bay Rd. in the Town of Huron, Wayne County. The armor stone will be placed above the mean high water level of the lake within a coastal erosion hazard area, with only disturbance at or below the mean high water level for equipment access.
