The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestors indicated above have submitted a BCP application for the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Genesee County - The Town of Batavia, as lead agency, has determined that the proposed Ellicott Street Road and Townline Road Water District will not have a significant adverse environmental impact. The action involves the Town of Batavia and the Town of Stafford undertaking an emergency project to provide public water to properties along Ellicott Street Road (Town of Batavia) and Townline Road (Towns of Batavia and Stafford). Due to a recent event involving the spreading of manure on a local dairy farm, a high percentage of drinking water wells are contaminated with E. coli and coliform bacteria. The proposed project involves the installation of 17,100 linear feet of watermain along Ellicott Street Road and Townline Road. Activities also include installation of a meter pit, lateral connections, fire hydrants, valves, watermain connections, excavation and bedding materials and surface restoration. The project is located on portions of Ellicott Street and Townline Road in the towns of Batavia and Stafford, New York.

Monroe County - The City of Rochester, Director of Zoning, as lead agency, has determined that the proposed Frederick Douglass Resource Center will not have a significant adverse environmental impact. The action involves the establishment of a community center (Frederick Douglass Resource Center) within an existing vacant industrial facility, demolish a 2500 square foot portion of the existing facility and construct a 3500 square foot addition. The project is located at 36-38 King Street, Rochester, New York.

Monroe County - The Town Board of the Town of Greece, as lead agency, has determined that the proposed Medical Office Buildings may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves Broadstone Real Estate, LLC proposes to rezone 17.8± acres of real property from BP-1 (Office) to BP-2 (Professional Office). The proposal is for a three story medical office buildings with related paved parking, utilities, grading landscaping/buffering and other site modifications. The proposal consists of two 43,000 square foot buildings in Phase 1 and one 38,000 square foot building in Phase 2, with an estimated project completion date date of 2012. The project is located at 2655 Ridgeway Avenue ( Monroe County Route 111), 900± feet west of Long Pond Road (Monroe County Route 136), Town of Greece, New York.

Monroe County - The Town Board of the Town of Greece, as lead agency, has determined that the proposed Hampton Ridge Center Commercial Development may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until August 17, 2007 at 5:00 p.m. The action involves 4320 West Ridge, LLC proposal to rezone 67.1 ± acres of real property from R1-12 (Single-Family Residential) to BG (General Business). The proposal is for 390,000± square foot of commercial development, with related paved parking, utilities, grading landscaping/buffering and other site modifications. The proposal consists of several buildings - some for freestanding, single uses, some for collection of tenants - with unspecified tenants and completion date that depend on the market demand. The project is located north of 4232-4350 West Ridge Road (NYS Route 104), between North Greece Road (Monroe County Route 144) and Manitou Road (NYS Route 261), Town of Greece, New York.
