The Department has prepared a draft SPDES permit (NY0269930) and made a tentative determination to approve the discharge of up to 1,500 gallons per day of treated sanitary wastewater from an on-site wastewater treatment system with a surface discharge to the East Branch Cazenovia Creek. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought. In commenting, please refer to this application by application number and SPDES number listed in this notice. A draft permit and application materials are available for inspection at the Region 9 Office.

The applicant proposes stream bank stabilization along Oatka Creek. In addition to installation of 150 feet of rock rip rap and a 500 foot tree revetment structure, the project includes installation of two grade control structures to help direct waterflow away from the bank, and two rock keys for additional bridge and gas line protection. A bypass channel will be constructed to allow work in the dry, and when the referenced operations have been completed, it will be changed to function as a highwater bypass channel to reduce bank erosion during flood events.
