Project Description:

The permittee has applied for a modification to the existin State Pollutant Discharge Elimination System (SPDES) permit to reduce the frequency of monitoring from once per week to once per month during the period October through April each year. The Department has made a tentative determination to issue a SPDES modification under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought, or for the overall project. The project is located on Golf Course Road in the town of Copake, Columbia County. SPDES #NY-0261092

Project Description:

The applicant is proposing to modify an existing mining plan/permit by increasing the Life of Mine by 1 acre to the east of the currently approved area and by increasing the depth of mining by 6' from 280' asl to 274' asl. The revised life of mine size will be 15.4 acres. The mine site is located on the east side of US Route 9, in the Town of Kinderhook, Columbia County, approximately 1/2 mile south of the Rensselaer County/Columbia County boundary.
