The site is located on the south side of Academy Hill Road, approximately 500 feet west of the intersection with North Road. Approximate 0.33 acre of the wetland 100-foot adjacent area would be disturbed and graded for the construction of a 240-foot portion of the common driveway, which will be 16 feet wide. All other construction and landcaping associated with the subdivision is outside the regulated area.

The Department has tentatively determined to issue a new SPDES permit to NYCDEP for the existing Wakefield Blowoff Discharge to the Bronx River from Hillview Reservoir. Discharge is located at the Wakefield Blowoff Outlet at Kimball and Hillview Avenues in the City of Yonkers. NYCDEP was required to apply for this SPDES permit as part of Order on Consent R3-20040419-40, which was signed to address the unpermitted discharge of water containing residual chlorine to the Bronx River. The draft permit contains effluent limitations for chlorine and pH, as well as monitoring and monthly reporting requirements. The issuance of this draft SPDES permit is a Type II action under 6 NYCRR Part 617.5(c)(29). SPDES Permit Number NY 027 0831.

Project Description:

The applicant requests a permit to remove approximately 1000 railroad ties from two concentrated areas of Croton Bay on the east side of the Metro North - Amtrak rail line and on each side of the Croton River Channel. The work areas are within and adjacent to, NYS designated freshwater wetlands H-3 (Class 1) and H-4 (Class 2). Croton Bay is a Significant Coastal Fish and Wildlife Habitat, designated Critical Environmental Area, Aesthetic Resource and of Archeological significance

The proposed project will involve the utilization of shallow draft, flat bottom boats which will transport crews to where the R.R. ties and fragments can be lifted out of the mud flats and transported to shore. The boats would be tethered so they can be pulled into the bay by a shore crew to reduce bottom scraping. Ties too large to removed will be cut into pieces at low tide and moved piece by piece when the tide rises enough to support the boats. Temporary work platforms made of plywood and wood planks would be used for the crew to cut and load ties. The ties will be disposed of through Waste Technology Services, Inc.
