Project Description:

The applicant proposes a discharge of 150 gallons of 1% Aluminum Sulfate (Alum) solution per acre to an additional 200 acres section of Honeoye Lake in an effort to bind phosphorus in the bottom sediments. During the 2006 treatment it became apparent that there were approximately an additional 200 acres, over the previously calculated total of 800 acres, of water with depths exceeding 18 feet. Additionally, 367 acres of the area treated in 2006 at an 82 gallon per acre rate will have up to 68 gallons per acre of alum applied in 2007 to bring the total application rate up to 150 gallons/acre. The modified draft State Pollutant Discharge Elimination System (SPDES) permit requires water quality monitoring pre-treatment, during the treatment, and post-treatment.The application will take place over an approximately 3 day period and be conducted using a treatment barge applying the alum through weighted hoses at least 6 feet below the lake's surface.

The Department has made a tentative determination to modify an existing SPDES permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. Approximately 11.2 acres of the expansion area will be added to the current 146.1 acre permit term. Mining will continue as a traditional drill and blast operation. Topsoil and overburden will be stripped and stockpiled for reclamation and/or berm construction. Exposed quarry faces will be backfilled and sloped as mining progresses through the expansion area, with final reclamation to open water when mining operations have been completed. The quarry is south of West Lee Road, west of State Rt. 98.

Project Description:

The Department has received an application from Glenn O. Hawbaker Inc for a 68.25 acre sand and gravel mine on a 175.17 acre parcel in the Town of Lindley. The mine site is located on Presho Lindley Road, approximately 1 mile southeast of Presho.

Excavation by front end loader is proposed to remove approximately 5 million cubic yards of sand and gravel over an estimated 15 year operational life of the mine. Material will be processed on site by a crushing, screening and washing plant. The applicant has estimated maximum truck traffic from hauling operations at 15 truck trips per hour.

Excavation is proposed below the local water table only for creation of the half acre wash water supply pond. Storm water runoff within the mined area will be retained within the mined area to allow infiltration into the soil. No discharges of storm water from the mined area are proposed or will be permitted There are no NY State regulated streams or freshwater wetlands within the mine area.

Final reclamation will restore the site to graded and re-vegetated meadow and open space, with the water supply pond filled in. Reclamation will include the replacement of stockpiled topsoil, and seeding with an approved mixture.

Hours of operation proposed are 6 AM to 6 PM Monday through Friday, and 6 AM to noon on Saturdays. No operations are proposed on Sundays and holidays. Final reclamation to open vegetated land is proposed, and will include the replacement of stockpiled topsoil and seeding with an approved mixture.

The application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Lindley.

Correction: A NYS Department of Environmental Conservation Notice of Complete Application was previously issued in the ENB and published in the Corning Leader on May 30, 2007 for a 360 permit modification for a new compost facility under DEC ID # 8-4699-000012/00005. The project location was incorrectly noted as the Town of Cameron. The location has been corrected to the Town of Thurston. The DEC ID # has been changed to 8-4666-00022/00001. In addition, the approved design capacity was previously noted as 3,800 dry tons per day. The design capacity of the Compost facility is more accurately described as approximately 4,900 tons per year of biosolids. The remainder of the information published previously is correct and can be referred to or you can review the ENB Notice dated 7/4/07. The public notice period for this project is extended to July 20, 2007.

As noted in the previous notice, the Department has made a tentative determination to approve an application for a 360 permit modification for construction and operation of a composting facility to treat dewatered wastewater treatment plant biosolids from 11 New York facilities and 4 Pennsylvania facilities to be located next to the existing facility at Bonny Road site in the Town of Thurston. The compost will be used on the fields fields which are permitted in the current permit. The facility will be land applying compost rather than the high water content biosolids therefore, the fields will receive less volume and have less potential for runoff. The file is available for review and comment at the NYSDEC Region 8 office.

The applicant proposes to renew and modify the existing mining permit for a 39 acre sand and gravel mine on Travell Knapp Corner Road.
