The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.
NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.
Please note the application package includes the Draft Remedial Investigation Work Plan which describes the remedial activities to be conducted to investigate and determine the nature and extent of the contamination related to the site.
NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Chautaugua County - The Jamestown Planning Commission as lead agency, has determined that the proposed BWB Center will not have a significant adverse environmental impact. The action involves the abandonment of two alleys by City of Jamestown, sale of approximately one acre to Krog Corp or another entity to be named, construction of approximately 48,000 sq ft, 3-story office/retail structure with 60 parking spaces. The project is located Southwest corner of West Third & Washington Streets, Jamestown, NY.

Erie County - The Mount Vernon Sewer District Board of Commissioners, as lead agency, has determined that the proposed Mount Vernon Sewer District Sanitary Sewer Rehabilitation (2007) will not have a significant adverse environmental impact. The action involves the replacement of approximately 2,910 linear feet of existing sanitary sewer to alleviate sanitary sewer overflows and the backup of sewage into residences at various locations throughout the Mount Vernon Sewer District. The project is located on Lake Shore and Clifton Parkway, Hamburg, NY.

Wyoming County - The Town of Middlebury, as lead agency, has determined that the proposed 2007 Amendments to the Town of Middlebury Zoning Law will not have a significant adverse environmental impact. The action involves the determination that comprehensive updates are necessary for regulating the development of wind power installations to protect the interests of the Town and its residents. The proposed amendments establish a permissive and discretionary framework for the establishment of Wind Energy Conversion Device/Facilities in the Town of Middlebury. The project is located in the Town of Middlebury, 51 Sherman Avenue, Wyoming, NY 14591.

Notice of Acceptance of Draft EIS and Public Hearing
Erie County - The Town of Amherst Town Board, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Rezoning of 218 and 330 Maple Road. A public hearing on the Draft EIS will be held on Thursday June 28, 2007 at 6:30 p.m. at the Town Hall, 5583 Main Street, Williamsville, NY 14221. Written comments on the Draft EIS will be accepted until August 17, 2007. The Draft Environmental Impact Statement (DEIS) can be reviewed at the Town of Amherst Planning Department, 5583 Main Street, Williamsville, and all Amherst Public Libraries and on the Town's website - www.amherst,ny.us . The action involves the rezoning of 33,326 ± acres of land from Residential District - Three (R-3) and Community Facilities (CF) to Multi-Family Residential District - Six (MFR-6) and General Business (GF) for a mixed-use development to consist of 250,000± feet of offices, 4,000 ± square feet community theater, a 125 room hotel and a 75 ± condominium units. The project is located at 218 and 330 Maple Road, between North Forest Road and Millersport Highway, Town of Amherst, NY.
