Project Description:
The permittee submitted an application for a State Pollutant Discharge Elimination System (SPDES) permit modification, along with an engineering report for upgrade of the Middletown wastewater treatment plant (WWTP), on August 12, 2005. The SPDES permit was modified and published several times since the original application, prior to final issuance. This notice is being run to describe yet another modification to the permit, as requested by the permittee, prior to final permit issuance. The current modification requested is for the purpose of restoring a monthly average flow limit to the permit, to remove the requirement within the permit for a continuous inflow and infiltration (I&I) program and to grant an additional 400,000 gallons per day of final discharge flow limit. Interim limits are contained in the current permit and final limits will be applied to a total flow of 8.5 million gallons per day after construction is complete.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:
The applicant proposes to place a swimming pool in the adjacent area of NYS designated wetland K-5 (Class 1) located in Bedford Hills, Westchester County. The pool will be 80 feet away from the wetland with a total limit of disturbance of 60 feet from the wetland. The applicant has agreed to have a low mow zone (2 times a year) around the pool, house and associated structures and a fenced area immediately adjacent to the low mow area which would separate the remainder of the property and maintain it in a natural state.
