The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Kings County (Brooklyn) - The New York City Department of Housing Preservation and Development (HPD), as lead agency, has determined that the proposed Atlantic Terrace Cornerstone Project will not have a significant adverse environmental impact. The action involves the new construction of a 10 story mixed-use building containing 80 condominium dwelling units on floors two through ten, 11,950 square feet of retail on the first floor and 14,026 square feet, 87 space parking garage on the sub-grade level. A second courtyard will provide 3,000 square feet of open space. The project is located at Atlantic Avenue, between South Oxford/South Portland, Brooklyn, NY.

Positive Declaration and Public Scoping

New York County (Manhattan) - The Metropolitan Transportation Authority, as lead agency, has determined that the proposed Emergency Ventilation Plant may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until 5:00 PM on July 26, 2007 at the Lead Agency. A public scoping session will be held on July 11, 2007 between 5:30 p.m. and 9:00 p.m.at the MTA NYC Transit, 2 Broadway, New York, NY, on the 20th floor. The action involves the construction of a vent plant, which may be be constructed either underground or at above-ground locations. The project is located at the 8th Avenue Subway Line (between West 4th Street and 14th Street Stations) and the 7th Avenue Subway Line (between Christopher Street and 14th Street Stations)

New York County (Manhattan) - The Office of the Deputy Mayor for Economic Development and Rebuilding, as lead agency, has determined that the proposed East 125th Street Development Site may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until July 23, 2007. A public scoping session will be held on July 12, 2007 at 6:00 p.m. at the Tiano Towers, 2253 Third Avenue, between East 123rd and 124th Streets in Manhattan. The action involves the proposed development of approximately 6 acres. The proposed development program will include: up to 477,000 square feet of retail, up to 1,000 mixed-income housing units, up to 300,000 square feet of media executive and creative office, production and post-production space, 30,000 square feet of not-for-profit performing, visual and media arts space and potentially a hotel up to 100,000 square feet. The project is located at 2323-27 Third Avenue, 2307-19 Third Avenue, 2293-95 Third Avenue in Manhattan, NY.
